According to the legal community on the 7th, the 2nd Division of the Supreme Court (Chief Justice Park Young-jae) confirmed the lower court last month that sentenced Mr. Kang (51), who was indicted on charges of attempted murder and courtroom disturbance, to five years in prison. He is accused of attempting to kill Mr. Lee by stabbing him in the neck several times with a weapon while he was sitting in the defendant’s box at the Seoul Southern District Court, where the fraud trial of Mr. Lee (41), CEO of Haruinbes, was held on August 28 last year.
At the time, Mr. Lee was being tried on charges of stealing 1.4 trillion won by gathering investors from March 2020 to June 2023, saying, ‘I will manage coin deposits to guarantee principal and pay the highest profits in the industry’, then suddenly stopped investors’ withdrawals and closed the office last year.
Mr. Kang was one of the victims who suffered a large loss after trusting Mr. Lee’s company and depositing coins. He, who continuously attended Mr. Lee’s trial, was found to have planned and executed the crime out of resentment that Mr. Lee had appointed a high-priced defense team without making any effort to recover from the damage.
Mr. Kang, who was indicted, claimed that he only had the intention to injure and did not intend to kill. However, the court rejected Kang’s claim and both the first and second trials sentenced him to five years in prison. The second trial court ruled, “This was a crime in which he prepared a weapon in advance, tilted the defenseless victim’s neck, and slashed it with excessive force several times,” and ruled, “It is difficult to deny the intent of murder by any standard.”
Meanwhile, Mr. Lee was put on trial on charges of violating the Act on the Aggravated Punishment of Specific Economic Crimes (fraud), but was found not guilty in the first trial last June. Currently, the second trial is underway at the Seoul High Court due to the prosecution’s appeal.
