Coupang CFS “We will bring back severance pay standards”

Coupang Fulfillment Service (CFS) announced that it would return the controversial severance payment standards for daily workers to the previous method. The current chief prosecutor in charge of the related case publicly testified that the prosecution command omitted key evidence and resulted in a decision of acquittal and non-indictment.

On the 15th, CFS CEO Jeong Jong-cheol appeared as a witness at the government audit conducted by the National Assembly Climate, Energy, Environment and Labor Committee on the Ministry of Employment and Labor and responded to questions from lawmakers by saying, “We have decided to return to the original standard to improve the treatment of daily workers.” He said, “The original intention was to clarify the standards for severance pay, but I am sorry for causing a lot of misunderstanding and confusion as a result,” and added, “We will proceed with the procedure in this regard as soon as possible and discuss all matters to avoid any damage.”

CFS is suspected of unfairly delaying the severance pay of daily workers by revising employment rules in May 2023. The existing employment rules stipulated that ‘if the continuous employment period of daily workers is more than 1 year, severance pay is paid, and when calculating the continuous employment period, less than 15 hours per week on average for 4 weeks are excluded.’ However, a ‘reset regulation’ was introduced to change this to ‘period of continuous employment for more than 1 year and an average of 15 hours or more per 4 weeks during that period.’ As a result, daily workers who were unable to receive severance pay suffered a series of losses.

The Bucheon Branch of the Ministry of Labor believed that CFS had systematically attempted to change the employment rules to disadvantages in order to avoid its obligation to pay severance pay, and sent a recommendation for indictment against Eom Seong-hwan, former CEO of the human resources department, to the prosecution, but the prosecution decided not to indict him in April.

Gwangju District Prosecutors’ Office Chief Prosecutor Moon Ji-seok, who was in charge of the investigation of this case at the Bucheon branch office from June last year to August this year, testified that the prosecution command at the time omitted key evidence and decided not to indict the case.

In response to a question from Kim Joo-young, a member of the Democratic Party of Korea, who asked, “Is the suspicion that Bucheon District Head Hee-joon Eom led the acquittal by omitting key evidence, etc.?” he replied, “Yes, the guidelines for the acquittal investigation were delivered, and in accordance with those guidelines, key search and seizure results were reported to the Supreme Prosecutors’ Office with the omission of key evidence, leading to a final non-indictment.” They judged that Coupang’s employment change rules should be prosecuted because they were illegal, and reported their opinion on prosecution to Deputy Chief Prosecutor Kim Dong-hee, but Deputy Chief Prosecutor Kim claimed that he said, “This is a clear case of innocence, and other offices are also acquitting the case,” and “Don’t waste your energy for no reason.”

Prosecutor Moon also said that Director Eom separately summoned the newly appointed chief prosecutor in February of this year and gave him guidelines for exonerating the Coupang case, adding, “At the time, Chief Eom had not seen any of the case records, so it is very unusual for him to directly call the investigating prosecutor and order the handling of the case.”

During his remarks on this day, Prosecutor Moon was unable to continue speaking for a while as if his throat was choked, and he also shed tears, saying that he hoped Coupang workers would receive severance pay. He said, “I think the prosecution should indict (Coupang),” and added, “I hope that workers who are socially disadvantaged quickly receive severance pay of at least 2 million won, and I hope that all public officials who acted inappropriately receive punishment commensurate with their mistakes.” There was applause from lawmakers in the hall.
