(1)Under the current criminal law, rape constitutes assault and intimidation. The perpetrator’s tangible power determines whether he is guilty of rape.
(2)If the rape composition is revised to the victim’s consent, even if there was no coercion, it can be punished if the other party does not agree.
(3)According to the current law, it has been pointed out that rape is not established if the victim did not actively rebel due to fear or shame and the perpetrator did not use enough violence and intimidation.
