A YouTuber who spread online a claim that the group’s chairman spent 100 billion won for his partner Kim Hee-young, director of the T&C Foundation, was indicted on charges of defamation and sentenced to probation in the first trial. However, the court ruled that some of the claims were not guilty of defamation related to Chairman Choi, saying, “It is difficult to conclude that they are groundless and false facts.”
According to the legal community on the 15th, Criminal Division 11 of the Seoul Northern District Court (Chief Judge Seo Young-hyo) sentenced YouTuber Park (70), who was sent to trial on charges of defamation under the Information and Communications Network Act, to one year in prison and three years of probation.
The court found Mr. Park guilty of defamation of Director Kim among the content he posted online. The court said, “Considering the seriousness of the case, we sentence you to imprisonment, but we postpone the execution of the sentence by taking into account the circumstances after the crime, the defendant’s criminal record, age, economic situation, and health condition.”
On the other hand, he was found not guilty on the charge of defamation by publishing false information against Chairman Choi. The prosecution believed that Mr. Park had defamed Chairman Choi by spreading false information that he had gifted or used 100 billion won to Director Kim, but the court did not accept this. The court ruled that the purpose of Mr. Park’s remarks was the amount used or transferred directly or indirectly for Director Kim and his children, including the establishment of a foundation, purchase of real estate, living expenses, and tuition.

The court said, “It is recognized that Chairman Choi has spent a total of over 60 billion won in direct expenses for the daughter and children he lived with or in connection with the cost of new housing,” and “Although the 100 billion won specified by the defendant is not recognized, it appears that Chairman Choi actually spent a huge amount of money for the daughter and her family.”
