Mr. A was indicted on charges of sexually assaulting Mr. D while he was lying down to sleep with his wife, B, father-in-law, C, mother-in-law, D, and brother-in-law, E, at their residence in September 2020. Two days later, he sexually assaulted Mr. D again while he was alone in the room.
Also, around July and August 2024, he entered the room of his brother-in-law E and raped him.
While drinking with his father-in-law in September 2020, Mr. A assaulted the drunk father-in-law by swearing and throwing a soju bottle because he could not communicate well.
Gangwon-do Yeongwol Branch, which was in charge of the first trial, said, “The nature of the crime is very bad, as it was an act that took advantage of the victims’ inability to properly rebel and reject the defendant’s heinous behavior,” and pointed out, “Even though they were in a family relationship, the defendant committed adultery with his mother-in-law to satisfy his sexual desires, and the crime was committed in the space where they lived together.” He also sentenced him to a heavy sentence, saying, “It is questionable whether he reflects with sincere apology to the victims.”
Mr. A, who appealed because the sentence was heavy, submitted 23 written reflections and appealed for leniency, but the second trial court upheld the original judgment.
