Man in his 40s exempted from military service by tricking time, sentenced to 1 year in prison

Busan District Court Criminal Division 6 (Chief Judge Kim Jeong-woo) announced that Mr. A, a man in his 40s who was indicted on charges of violating the Military Service Act, was sentenced to one year in prison.

Mr. A was accused of being placed on wartime labor four times from July 24, 2019 to December 31, 2020, by concealing his whereabouts or using deception until he reached an age where he could not fulfill his enlistment obligation.

Mr. A, born in 1983, entered the country in May 2019 after living abroad, and two months later, in a military service examination, he was judged to be over 36 years old and subject to convocation as a social service worker.

Mr. A, who did not like this, followed the instructions of the military service broker and started to bide his time with the goal of being disposed of for wartime service.

Wartime workers do not have military service obligations in peacetime and are required to support military work only in wartime situations, so they are effectively exempt from active duty.

Mr. A did not enlist in the military even after learning that his maternal uncle had received a notice of call-up to become a social worker on July 24, 2019, and did not receive any contact from the local military branch office.

At the time, his address was in Incheon and he had not even registered his move to Busan, his actual residence.

After belatedly reporting his move to Busan, he submitted a false fact-confirmation letter to the Incheon Military Manpower Branch stating that he “did not receive a call-up notice,” and the call-up notice was canceled.

After receiving the call-up notice sent by the Busan Military Manpower Administration, I was admitted to the hospital without feeling sick. After being discharged, the Busan Military Manpower Administration sent the call-up notice again, so they canceled the call-up notice by changing my address to Incheon.

Mr. A turned 38 in this way, and was assigned to wartime labor, which was his original goal.

Chief Judge Kim ruled, “He was sentenced to wartime labor by concealing his whereabouts and using deception for the purpose of avoiding military service. He was in fact exempted from military service, so he needs to be punished accordingly.”
