power of civil war

1. Violations of the Constitution

1.1 Article 46 of the Constitution (Duties of National Assembly Members) – Article 46, Paragraph 2 of the Constitution stipulates that “Members of the National Assembly shall perform their duties according to their conscience, giving priority to national interests.” -The People Power Party members’ intentional absence from voting on the impeachment bill was a clear violation of their constitutional duties as they ignored national interests and prioritized partisan interests.

1.2 Article 1 of the Constitution (Principle of Popular Sovereignty) – Article 1 of the Constitution states that “all power comes from the people.” -The act of members of the National Assembly, as representatives of the people, not representing the will of the people and systematically disrupting the quorum for voting is a seriously unconstitutional act that undermines the principle of popular sovereignty. 1.3 Article 8 of the Constitution (Roles and Responsibilities of Political Parties) – Article 8 of the Constitution stipulates that political parties must comply with the basic democratic order. -If the People Power Party interfered with democratic procedures and encouraged undemocratic acts at the party level, this was a direct violation of Article 8 of the Constitution.

2. Violations of the National Assembly Act 2.1 Article 114 of the National Assembly Act (Obligation to attend plenary sessions) – Article 114 of the National Assembly Act states that “Members of the National Assembly must attend plenary sessions.” -The mass absence of National Assembly members belonging to the People Power Party from voting on the impeachment bill is a violation of their obligation to attend the plenary session and is an act of neglect of the basic responsibility of National Assembly members.

2.2 Article 122 of the National Assembly Act (Procedures for impeachment impeachment) – Article 122 of the National Assembly Act stipulates that “a bill for impeachment must obtain the approval of more than two-thirds of the registered members.” -A number of People Power Party members intentionally refused to vote and thus obstructed the impeachment resolution process, violating Article 122 of the National Assembly Act.

3. Violations of political party law

3.1 Political Parties Act Article 38 (Responsibility of Political Parties)

– Article 38 of the Political Parties Act states that “political parties must contribute to the formation of the political will of the people and democratic operation.” – If there are circumstances in which the People Power Party systematically ordered or assisted voting rejection at the party level, this would be a betrayal of its basic responsibility as a political party.

3.2 Article 44 of the Political Party Act (Restrictions on Political Party Activities)

– Article 44 of the Political Parties Act stipulates that “if a political party violates the basic democratic order, the Constitutional Court may order the dissolution of the political party.”

– If the People Power Party’s systematic actions have undermined the principles of democracy, it should be subject to dissolution in accordance with Article 44 of the Political Parties Act.
