Last year, A, a minor, was injured in an accident while driving an electric kickboard without a license, violating a traffic signal and colliding with a vehicle. The treatment cost alone (compensation to the corporation) amounted to approximately 40 million won. However, the National Health Insurance Corporation believed that the cause of the accident was a ‘criminal act due to gross negligence’ and deemed the paid medical expenses as unfair profits and issued a recovery notice.
If an accident occurs due to a violation of traffic laws while driving an electric kickboard, etc., the National Health Insurance Corporation may be subject to benefit restrictions under the National Health Insurance Act (Articles 53 and 57), and the Corporation’s contribution for treatment of the injury may be recovered. Therefore, on the 1st, people were urged to follow traffic laws.
The Corporation emphasized that traffic accidents due to unlicensed driving and traffic signal violations, especially among middle and high school students who lack understanding of related laws such as the Road Traffic Act, are increasing, so the public needs to be more aware of safe driving.
