(1)On the 24th, Daejeon District Court’s 5-3 Criminal Division (Presiding Judge Lee Hyo-seon) overturned the original trial sentence of 9 years in prison in the appeal trial of Mr. A, a real estate enlistment agent indicted on charges of fraud, and sentenced him to 7 years in prison. The court also overturned the original sentence of 9 years in prison for broker B, who was also brought to trial on charges of helping Mr. A commit the crime, and sentenced him to 3 years and 6 months in prison.

(1)The appellate court said, “The failure to return the deposit while managing the proceeds of crime was a result of Mr. A’s investment failure, so the responsibility is great,” and added, “The defendant made an effort to recover the damage by providing a deposit of 1 million won to each of the 30 victims. Considering that 1 billion won of the damage is expected to be recovered through the villa auction, the centrifugal sentence is too heavy.
